Abstract

Besides our pastoral solicitude, a report that there has been a decline in Church marriage in Africa in the past few years, and a survey by Adrian Hastings which reveals that cultural factors are as well responsible for this trend (1), prompted us to undertake the present; study of customary law of marriage in Uganda. It is a study in search of adaptation called for by Vatican II.Our thesis is, accordingly, a synthesis of· existing customary marriage law of the different ethnic groups that make up the population of Uganda and the interpretation of it against the social and juridical background of the country. Comparative approach is often adopted whenever it is felt that this points out a parallel in the universal elements of marriage. It will be seen that the family values are lived in different forms according to the human contexts in which they are embodied. For this reason, the Church will be strongly urged to regard as properly married those baptized persons who are united according to customary formalities, and not to keep on cutting them off from communion. I take this opportunity to express my deep gratitude to the Rt. Rev. Caesar Asili, Bishop of Lira, for having made it possible for me to read law in Lateran University.
